SUBJECT:
A Resolution Accepting the Dedication of Easement located at 3900 Sussex Avenue, being Lot 1 in Sussex Court Subdivision (T-Mobile - Legistar 24-0232 / NA17/4-24.164-DED/E - SB - WARD 10)

PURPOSE:
The Engineering Department is requesting approval of a ten (10) foot wide City Watermain Easement on the property located at 3900 Sussex Ave. The easement is being requested to allow for ongoing maintenance of the Subject Property. The easement is proposed to connect to the existing watermain that runs along Sussex Ave.

The Subject Property zoned M-1, Manufacturing District - Limited. City Staff has completed an internal review of the Subject Property to allow for expansion of outdoor storage for a light industrial user. The Subject Property and the proposal is otherwise in compliance with the applicable M-1 zoning district standards. The development is not required to secure any additional review processes or public meetings for the Zoning Division's review.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

WHEREAS, it may be necessary in the future to construct and provide utilities in the easement area; and
