SUBJECT:

Requesting Authorization for the Mayor to Execute the Local Agency Agreement for Federal Participation with the State of Illinois in the amount not to exceed $57,710.00, the Director of Purchasing to sign the Phase 2 Preliminary Engineering Agreement with Patrick Engineering, Inc. and the Appropriation of Motor Fuel Tax Funds for Edgelawn Drive Bikeway Project, MFT #16-00312-00-BT in an amount of $57,710.00.

 

PURPOSE:

To execute the Local Agency Agreement to reserve sufficient funds to cover the upfront cost of Phase 2 engineering by resolution, to approve the Phase 2 Preliminary Engineering Services Agreement with Patrick Engineering, Inc. and to Appropriate Motor Fuel Tax (MFT) funds by IDOT Resolution).

 

BACKGROUND:

The City has been progressively making bicycle and pedestrian improvements for its residents, commuters, visitors and recreational bikeway users. Due to such efforts, City is also recognized as a Bicycle Friendly Community at the Bronze level by League of American Bicyclists.

 

Edgelawn Drive Bikeway project is recognized in the City of Aurora Bicycle & Pedestrian Plan. The project limits are from Indian Trail to Virgil Gilman Trail on Edgelawn Drive, project extends east on Prairie Street up to LeGrande Boulevard, continuing north on LeGrande Boulevard to Garfield Avenue, then west on Garfield Avenue to Gladstone Avenue and north on Gladstone Avenue to finally terminate at Galena Boulevard intersection (at West Aurora High School).

 

The project will connect and provide access to Indian Trail Path at north, Virgil Gilman Trail to its south and provides a bikeway through the residential streets to access West Aurora High School and Aurora University.

 

Improvements will include: striping on-street bike lanes, Shared Lane Markings (Sharrows), Pavement Markings, extending shoulders to fit on-street bike lanes, ADA improvements and signage.

 

The project has acquired Congestion Mitigation and Air Quality (CMAQ) federal funds in the amount not to exceed $554,018.00. The total project cost is estimated at $692,523.00 (Phase 2 Engineering, Construction & Const. Engineering) 

 

DISCUSSION:

Due to federal funding involved in Phase 2 Preliminary/Design engineering, City was required to go through Quality Based Selection (QBS) process to select a consultant to complete Phase 2 engineering for the project. QBS proposal was posted on December 27, 2018 on City Website, a total of 10 QBS proposals were received. Patrick Engineering, Inc. was selected to conduct Phase 2 design engineering by City staff through the ranking system. QBS ranking attached.

 

City will have to execute the Local Agency Agreement by setting aside the upfront cost for Phase 2 engineering for the project. The estimated total cost of construction [C] is approximately $577,102.00.

City will have to front fund Phase 2 Preliminary/Design Engineering cost and 80% of this cost will be reimbursed by IDOT, at a later date. The estimated total cost of Phase 2 Eng. Cost is $57,710.00.

 

IDOT requires a Resolution to Appropriate the MFT funds prior to their expenditure for approved projects. The Resolution for Improvement - BLR 09110 appropriating MFT funds in the amount of $57,710.00 is attached.

 

The 2020 FFY budget provides the funds through the following account:

RECOMMENDATIONS:

Staff recommends execution and approval of the Local Agency Agreement, Phase 2 Preliminary/Design Engineering Agreement with Patrick Engineering, Inc. and appropriate the MFT funds in the amount of $57,710.00 for section no. 16-00312-00-BT.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City intends to improve bicycle and pedestrian facilities for better connectivity and accessibility to regional/local trails - Edgelawn Drive Bikeway project looks at making those connections to trails, school and university within the project limits (i.e., from Indian Trail to Virgil Gilman Trail on Edgelawn Drive, project extends east via Prairie street from Edgelawn Drive to LeGrande Boulevard, continuing north on LeGrande Boulevard to Garfield Avenue, continuing west on Garfield Avenue to Gladstone Avenue and then continuing north on Gladstone Avenue to finally terminate at Galena Boulevard intersection (opposite to West Aurora High School)), the project is approximately 3.9 miles in length, that consists of striping bike lanes, shared lane markings (Sharrows), bike routes, pavement markings, striping, excavation to extend shoulders to accommodate bike lanes, signage and other pertinent work. The project has a State Job No.: D-91-251-16, Project No.: 2IEV (098) and MFT Section No.: 16-00312-00-BT.

 

WHEREAS, Edgelawn Drive Bikeway Project has been awarded Congestion Mitigation and Air Quality (CMAQ) federal funding in the amount not to exceed $554,018.00, (i.e., for Phase 2 Engineering ($46,168.00), Construction ($461,682.00) and Construction Engineering ($46,168.00))

 

WHEREAS, the use of federal funds requires the City to execute the Local Agency Agreement with IDOT by way of appropriating the total up front cost for Phase 2 Preliminary Engineering in the amount of $57,710.00 ( 80% of which is reimbursed by IDOT at a later stage) of which the agreement is attached

 

WHEREAS, there is a need to execute Phase 2 Preliminary Engineering with Patrick Engineering, Inc. in order to continue the project of which the agreement is attached

 

WHEREAS, there is a need to appropriate Motor Fuel Tax (MFT # 16-00312-00-BT) funds for this project in the amount of $57,710.00 a copy of which resolution is attached for approval.

 

WHEREAS, the City of Aurora FFY 2020 Budget provides funds by way of the following account:

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: subject to the approval of this item in the 2020 budget, that the City of Aurora authorizes fifty seven thousand seven hundred and ten dollars ($57,710.00) or as much may be needed to match federal funds in the completion of the aforementioned project with the MFT Section Number 16-00312-00-BT, that the Mayor is authorized to execute the Local Agency Agreement for Federal Participation with the Sate of Illinois (LAA attached), the Director of Procurement to sign the Phase 2 Preliminary/Design Engineering Agreement with Patrick Engineering, Inc. (Phase 2 Preliminary Engineering attached) and the City Clerk to sign the Motor Fuel Tax Resolution (IDOT resolution attached).

 

BE IT FURTHER RESOLVED that the Mayor is hereby authorized any other such documents related to advancement and completion of the said project.
