SUBJECT:
An Ordinance amending Chapter 42, Section 22, of the City of Aurora Code of Ordinances Entitled "Mailboxes."
PURPOSE:
This proposed amendments seeks to update the City's Ordinance to comply with the United State's Postal Services' regulations for installation and maintenance of mailboxes. It also seeks to update the City's process for providing reimbursement for mailbox damage caused by a City plows or City contracted plows.
BACKGROUND:
Last winter we received approximately 120 claims for mailbox damage caused by snow plows. The volume of claims led to a staff review of the City's mailbox ordinance and reimbursement policy. The review found that the ordinance was outdated and no longer complaint with United State's Postal Services' standards.
DISCUSSION:
This proposed amendment would increase the reimbursement amount to seventy five dollars ($75.00) for mailboxes damaged by snowplows. It would also update mailbox installation and maintenance requirements to comply with the USPS standards.
IMPACT STATEMENT:
This proposed amendment would benefit residents by expediting the claim process as well as increasing the amount of potential reimbursement.
The proposed amendment would benefit the City and staff by allowing the current policy to be updated and streamlined. It would also allow City the City Engineer and Corporate Counsel to reevaluate and modify the policy as needed to ensure an expedited claim process.
RECOMMENDATIONS:
It is recommended that this proposed amendment be approved and forwarded to Committee of the Whole.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, it is in the best interest of the City, staff, and residents of Aurora to update Chapter 42, Section 22 of the City of Aurora Code of Ordinances:
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: that Chapter 42, Section 22, of the Aurora Code of Ordinances hereby be amended as reflected in the attached Exhibit A.
