SUBJECT:

An Ordinance Adding Article 8 to Chapter 41.5, of the Code of the City of Aurora.

 

PURPOSE:

To allow the City to use golf carts on roadways for the limited purpose of special events.

 

BACKGROUND:

The City has purchased ADA compliant golf carts and wishes to use them as well as other golf carts for special events.

 

DISCUSSION:

Under Illinois law, it is generally "unlawful for any person to drive or operate a non-highway vehicle upon any street, highway, or roadway in this State." 625 ILCS 5/11-1426.1(b). The State statute however allows for local government to authorize by ordinance or resolution the use of non-highway vehicles on roadways if the local unit of government has determined that public safety will not be jeopardized. 625 ILCS 5/11-1426.1(d).  The proposed ordinance seeks to allow City employees and agents to use of non-highway vehicles upon the roadways for the limited purposes of special events. The proposed ordinance also outlines various safeguards to ensure that public safety will not be jeopardized.

 

IMPACT STATEMENT:

The proposed ordinance will allow our special events employees and agents to operate golf carts and the ADA compliant golf carts for special events. The golf carts will be able to be used to set up, organize, and disassemble special events more efficiently. The ADA golf carts will be used to transport people using the handicapped parking lot to special events, specifically those at River Edge Park.

 

RECOMMENDATIONS:

That this proposed Ordinance be approved and adopted.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, it will benefit the City to allow for the use of non-highway vehicles on roadways for the limited purposes of special events;

 

WHEREAS, allowing the use of non-highway vehicles on roadways for this limited purpose will not jeopardize public safety;

 

WHEREAS, pursuant to 625 ILCS 5/11-1426.1(d);

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: hereby adopts Article VIII of Chapter 41.5 as set forth in Exhibit A.
