SUBJECT:

An Ordinance Providing for the Execution of an Easement Agreement between the City of Aurora and Lincoln Prairie Aurora, LLC for a Drainage Easement on the property located south of Wolf’s Crossing Road between Heggs Road and US Route 30 (Lincoln Prairie Aurora, LLC - 19-0669 / WH18/1-19.131-DED/ROW - TV - Ward 9)  

 

PURPOSE:

The request is for approval of an Easement Agreement between the City of Aurora and Lincoln Prairie Aurora, LLC for a Drainage Easement on the property located south of Wolf’s Crossing Road between Heggs Road and US Route 30.  The easement is located along of both side of the proposed right of way dedication for Eola Road realignment and will allow for grading within this area.

A Ordinance Providing for the Execution of an Easement Agreement between the City of Aurora and Lincoln Prairie Aurora, LLC for a Drainage Easement on the property located south of Wolf’s Crossing Road between Heggs Road and US Route 30

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora desires to enter into an Easement Agreement with Lincoln Prairie Aurora, LLC providing a Drainage Easement on the property located south of Wolf’s Crossing Road between Heggs Road and US Route 30 in the form of   Exhibit “A” attached hereto; and 

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, that the City Council of the City of Aurora hereby authorizes and directs the Mayor and the City Clerk to enter into the Easement Agreement with Lincoln Prairie Aurora, LLC as attached hereto as Exhibit “A” and made part hereof.
