PURPOSE:
To obtain council approval for a resolution approving the Second Amendment to the Intergovernmental Agreement between the City of Aurora, the City of Naperville, and the Naperville Township Road District to widen North Aurora Road in the vicinity of the CN Railway Crossing
BACKGROUND:
The project is a joint multi-jurisdictional project with the City of Aurora, City of Naperville, and Naperville Township Road District to improve the regional transportation network.
This is an ongoing project that began in 2006 with Phase 1 Engineering. Phase 1 was completed and accepted by IDOT in 2016. In 2016, Council approved the first Amendment to the Intergovernmental Agreement that covered the right of way acquisition for the project. The project is currently in process of land acquisition.
The current boundary agreement between the City of Aurora and City of Naperville commits the City to the Phase 2 process covered under this amendment. The City of Naperville is the lead on this project.
By completing the Phase 2, the project will be in a better position to apply for grant funding as it becomes available for final construction. The anticipated construction costs are anticipated to exceed $30,000,000. However, the current boundary agreement limits the City of Aurora contribution to a little over $3,000,000 of the total cost and construction would not move forward without mutual consent of both cities.
Lastly, at the point in time that grant funding may become available, the Administration will need to consider where this project sits with regards to transportation priorities, given limited funding and uncertain revenues under current environment in the State of Illinois. While there is a recognized regional transportation benefit, this project has substantial benefit to adjoining properties in Naperville, and little direct benefit to adjoining properties in the City of Aurora.
DISCUSSION:
Phase 3 of the project is the Phase II design of the project. The design will include a five lane section with sidewalk on one side and a multi-use path on the other. This will require a lengthening the of the CN tracks over North Aurora Road.
The City would be required by this agreement to contribute $400,000.00 in 2017 and an additional $310,000 in early 2018 for a total of $710,000. Fund are made available in the FY 2017 approved budget:

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City desires to construct the widening of North Aurora Road under the CN Railway Crossing
WHEREAS, the City has partnered with the City of Naperville and Naperville Township Road District to complete such construction
WHEREAS, the FY 2017 City of Aurora Budget provides funding by way of the following account:
