SUBJECT:
An Ordinance Creating Article III of Chapter 46 entitled "Private Property Immobilization" establishing a licensing program for the immobilization of vehicles on private property

PURPOSE:
Due to reported negative experiences of both Aurora residents and visitors to Aurora regarding immobilization or "booting" of motor vehicles on private property, this Ordinance was created to license a program by which the City can more closely regulate such booting of vehicles and the businesses that perform this service, provide for clear written notice to the public at large, and to prevent predatory and/or fraudulent booting practices for the welfare of both our residents and visitors to our city.

BACKGROUND:
The Legal Department and the Police Department worked together to research other jurisdictions existing regulations and license programs that we could assemble into a viable licensing and regulating policy for use in Aurora. After review of several jurisdictions policies, we have drafted the attached Ordinance to create a license and regulatory policy that we believe is fair and specific enough to give all private property owners as well as vehicle drivers and the businesses which operate booting services notice of the requirements in our city.

DISCUSSION:
First and foremost, this Ordinance creates a license program for all vehicle immobilization services, in order that we can know who operates such businesses in Aurora in case of complaints received, such license application and processing to be handled by the Police Department.
The application requirements are stringent enough to give the police department good information about the entity or person who seeks to operate an immobilization service in Aurora, and includes a requirement that there be no prior convictions for any felony within three years prior to application.
