SUBJECT:
An ordinance amending Chapter 8 - AMUSEMENTS, Division 5 - VIDEO GAMING, Section 8-131 of the City of Aurora Code of Ordinances Entitled "Licensee requirements"

PURPOSE:
The proposed amendment seeks to allow for a potential distance reduction for a video gaming terminal license applicant.

BACKGROUND:
In 2018 the City amended the ordinance to prohibit video gaming terminals within 2,640 feet (one half mile) of an existing establishment with video gaming terminals.

DISCUSSION:
There may be certain circumstances where the issuance of a video gaming terminal license within a half mile of an existing license may not be detrimental to the area. This amendment allows establishments within 2,640 feet of another existing video gaming license to apply for a reduction in the distance requirement. If an application is submitted it would be reviewed by an administrative hearing officer. The hearing officer would review six factors and make a recommendation to the liquor commissioner as to whether or not to grant the reduction.

IMPACT STATEMENT:
This proposed amendment would allow for video licenses to be issued within a half mile of an existing video gaming establishment in limited circumstances when granting the license will not be detrimentally impact the existing licensee or the surrounding community.

RECOMMENDATIONS:
It is respectfully requested that the proposed amendment to Chapter 8 be approved and forwarded to the Public Health, Safety and Transportation Committee for review.
