SUBJECT:
Resolution Establishing the Maximum Number of City of Aurora Liquor Licenses by Class.

PURPOSE:
To increase the number of Class G - Package Beer and Wine licenses by one (1) license, increasing the total maximum number of Class G licenses to 15.

BACKGROUND:
This request is presented in accordance with the 2011 amendment to the City's Liquor Ordinance, specifically Section 6-9(a), which charges the City Council with the authority to determine the number of licenses available in each classification.

DISCUSSION:
Carniceria El Paso Grande Corp., d/b/a El Paso Grande, located at 634 E. New York St., has submitted a liquor license application seeking a Class G license for the purpose of selling to the general public beer and wine in original packages only, for consumption off the premises where sold.

Per Sec. 6-7 of the City of Aurora's Liquor Ordinance, any sale, transfer, or assignment of fifty (50) percent or more of the ownership of a business shall terminate the license. El Paso Grande has been operating out of this location for nearly two decades, but there was a recent change in the corporate ownership. The change in ownership automatically decreases the number of available liquor licenses by one (1), thus requiring City Council approval to increase the same by one (1) in order to accommodate the new licensee. There will be no net change in the number of available class G licenses.

Attached is the application submitted for your consideration. City staff has been working with the business owner to ensure that all requirements for a liquor license, as set forth in Chapter 6 of the City's Code of Ordinances, are met.
