SUBJECT:
A Resolution to Enter into a Three (3) Year ATM Space Lease Agreement with Old Second Bank.

PURPOSE:
A Resolution to Enter into a Three (3) Year ATM Space Lease Agreement with Old Second Bank.

BACKGROUND:
Old Second Bank currently has four (4) ATMs located throughout the City: one at each train station, City Hall, and the Phillips Park Golf Course. The last ATM lease was executed in 2023 and will expire on December 31, 2025. That lease allowed for five (5) ATMs to be billed, but Old Second has since removed one of the ATMs previously located at APD due to minimal usage.

DISCUSSION:
The City and Old Second Bank both seek to continue the relationship allowing the Bank to place ATMs at various City locations. Executing the attached lease will allow the City to continue to collect rent for the four (4) locations and allow the Bank to continue to benefit from the placement of these ATMs.


IMPACT STATEMENT:
This resolution will have a positive impact by allowing patrons access to ATMs and the City to collect rent on the lease agreement.

RECOMMENDATIONS:
Staff recommends the approval of this Resolution.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

WHEREAS, Old Second Bank has four (4) ATMs located throughout the City; and
