SUBJECT:
Resolution Establishing the Maximum Number of City of Aurora Liquor Licenses by Class.

PURPOSE:
To increase the number of Class C - Package Liquor by one (1) license, increasing the total maximum number of Class C to 40.

BACKGROUND:
This request is presented in accordance with the 2011 amendment to the City's Liquor Ordinance, specifically Section 6-9(a), which charges the City Council with the authority to determine the number of licenses available in each classification.

DISCUSSION:
Balaji Food & Liquor, Inc. d/b/a Jay's Food Pantry, located at 3450 Montgomery Rd. - Unit 12, has submitted a liquor license application seeking a Class C license for the purpose of selling alcoholic liquor to the general public in original packages only, for consumption off the premises where sold.

This location currently holds a Class C liquor license under Maruti Foods & Liquor, Inc. d/b/a Jay's Food Pantry. The change in ownership would automatically decrease the number of available liquor licenses by one (1), thus requiring City Council approval to increase the same by one (1) in order to accommodate the new licensee.

Attached is the application submitted for your consideration. If approved, this resolution would increase the number of allowable liquor licenses as indicated in the accompanying Exhibit A to allow for the issuance of the license by the Commissioner. City staff has been working with the business owner to ensure that all requirements for a liquor license, as set forth in Chapter 6 of the City's Code of Ordinances, are met.

IMPACT STATEMENT:
The proposed resolution presents an opportunity to further the City of Aurora's economic development.
