PURPOSE:
To pass a Resolution allowing the Mayor and City Clerk to enter into an Agreement to Reduce Density and further a Memorandum of Agreement to be recorded in the Kane County Recorder's Office memorializing said Agreement.

BACKGROUND:
Buckley and Gillett own property located on Pennsylvania Avenue. Said Property has one Permanent Index Number, but there are two residences erected thereon both of which are operated as rental units. There evidently have been numerous neighbor complaints and police calls at the Property. The front or easterly residence has the address of 723 Pennsylvania Avenue, while the back or westerly residence has the 721 address.

DISCUSSION:
The Property is now listed for sale and there is an opportunity to reach an Agreement with the owners to have the 721 Pennsylvania residence demolished thereby reducing density. The City will pay $72,000.00 to owners for the right to demolish the 721 residence. The Agreement also provides for an easement to the City to allow this demolition and further provides that the Property can only be sold to Buyer(s) who will occupy it as a single family residence. Further the Agreement provides that any Contract with potential buyer(s) will contain conditions allowing the City to demolish the 721 property and that the buyer(s) will occupy the property as a single family residence

FUNDING SOURCE: There is adequate funding under account number 215-1330-463-72.03

IMPACT STATEMENT:
