SUBJECT:
A Resolution Accepting the Dedication of a City Easement located south of Ferry Road and east of Frieder Lane (Old Dominion Freight Line, Inc. - 18-1151 / NA04/1-18.221 - DED/E - JM - Ward 10)

PURPOSE:
The Engineering Division is requesting approval of a Plat of Easement for a City Easement located south of Ferry Road and east of Frieder Lane. The details of the proposal include a Plat of Easement for an offsite City Easement on the eastern portion of the property that was formerly 2450 Frieder Lane, which is now owned by Old Dominion Freight Line, Inc., to service the development of Lot 401 of Butterfield Phase II, Unit 4B as a warehouse approved per resolution PDFNL2017-002. The easement abuts the proposed extension of Frieder Lane to the east and future Sunrise Road to the north.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

WHEREAS, it may be necessary in the future to construct and provide utilities in the easement area; and

WHEREAS, upon petition of the property owners, Old Dominion Freight Line, Inc., the City of Aurora has been offered in dedication suitable vacant land for the purpose of locating utilities and/or providing stormwater detention within an easement(s) as des...
