SUBJECT:
Resolution Establishing the Maximum Number of City of Aurora Liquor Licenses by Class.

PURPOSE:
To establish the number of Class A - Tavern license for the number of Class A licenses at 11.

BACKGROUND:
This request is presented in accordance with the 2011 amendment to the City's Liquor Ordinance, specifically Section 6-9(a), which charges the City Council with the authority to determine the number of licenses available in each classification.

DISCUSSION:
Fun Eats and Drinks d/b/a Fox & Hound #65061 to located at 4320 E. New York Street, has submitted a liquor license application for a Class A license for the purpose of selling to the general public alcoholic liquor by the drink for consumption on the premises where sold. Fox & Hound Sports Tavern was previously owned and operated by Last Call Operating Co., Inc. Through a bankruptcy proceeding Fun Eats and Drinks, LLC obtained ownership of Fox & Hound Sports Tavern. This application is to make the change to the new owners of record for the establishment.

Attached is the application submitted for your consideration. If approved, this resolution would maintain the number of allowable liquor licenses as indicated in the accompanying Exhibit A to allow for the issuance of the licenses by the Commissioner. City staff has been working with the business representatives to ensure that all requirements for a liquor license, as set forth in Chapter 6 of the City's Code of Ordinances, are met.

IMPACT STATEMENT:
The proposed resolution presents an opportunity to further the City of Aurora's economic development.

RECOMMENDATIONS:
I am recommending that this resolution be referred to the January 17, 2017 meeting of the Committee of the Whole for consideration.
