SUBJECT:
A Resolution Approving the Final Plat for Fox Valley Medical/Business Campus Resubdivision No. 1, Aurora, Illinois 60504 (MB Financial - L14-00845 / NA28/1-14.118-Fsd - AM - Ward 10)

PURPOSE:
The Petitioner, MB Financial, is requesting approval of a Final Plat for Fox Valley Medical/Business Campus Resubdivision No. 1 located at 4151 McCoy Drive. The details of the proposal include the conveyance of the easterly 20 feet of Lot 2 to contract purchaser of Lot 1, the adjacent property located at 4151 McCoy Drive.

BACKGROUND:
The Subject Property is located at Lots 1 and 2 of the Fox Valley Medical/Business Campus Subdivision - 4151 McCoy Drive. Lot 2 is currently vacant and the underlying zoning is FVERII Planned Development District (PDD) and Lot 1 is 5.203411 Acres with one (1) existing building of 44,299.5 sq. ft. currently vacant but constructed for commercial purposes and has one hundred sixty five (165) parking spaces. A Final Plan and Plat was approved in March of 2007 for Lot1 along with a Special Sign District for the KVR Investments project, Resolution R07-147 and Ordinance O07-031 respectively. The high small lifestyle center was constructed in 2008 however, due to the economic downturn was never occupied. The current Petitioner is new owner and is beginning to seek tenants for the building

DISCUSSION:
Staff has reviewed the Final Plat petition, submitted by the petitioner and have sent comments back to them on those submittals. The petitioner has made all the requested changes to these documents and they now meet all of the applicable codes and ordinances. Staff supports the re-subdivision however, staff has concerns regarding the ability for the Petitioner to utilize the additional 20 feet for additional parking here based on drive access, cross access easements, and setbacks.
