A Resolution Authorizing the Execution of an Easement Agreement between the City of Aurora and Chicago Title Land Trust Company Trust #1122, for the Vacant Property located near the Northeast Corner of Eastern Avenue and East New York Street (City of Aurora - 23-0448 / AU24/4-23.305-DED/E - SB - Ward 7)

PURPOSE:
The Engineering Division is requesting approval of an Easement Agreement with the owner of the approximately ten (10) acre vacant property located near the northeast corner of Eastern Ave. and E. New York St. The Easement Agreement is intended to grant the dedication of a twenty (20) foot wide public storm sewer easement, as well as construction and maintenance of the storm sewer easement. The Easement Agreement is proposed to allow for continued improvements along this section of East New York Street.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

WHEREAS, OLD SECOND NATL BK TR#1122 HEDRICH, RAYMOND O is the owner of record of the real estate legally described in Exhibit "A", attached hereto and incorporated herein by reference as if fully set forth, and hereinafter referred to as Exhibit "A"; and
