SUBJECT:
A Resolution Authorizing an Intergovernmental Agreement between the City of Aurora and the City of Warrenville regarding the Disconnection and Annexation of Certain Territory (DUKE REALTY)

PURPOSE:
To allow for the disconnection of certain property from Aurora, and the annexation to Warrenville in order for the Village of Warrenville to assume intersection construction responsibilities.

BACKGROUND:
Duke Parkway, a proposed right-of-way in Aurora located in Duke Realty's Butterfield Business Park, ultimately will terminate at Rt. 59. In the past, discussions with IDOT on this intersection involved several million dollars of improvements, as well as the need to terminate an existing roadway (Estes Drive) that currently "T's" into Rt. 59 just north of the proposed Duke Parkway. Estes Drive is located in the Village of Warrenville.

DISCUSSION:
The Duke Parkway intersection also has benefits to Warrenville. To the east of the intersection is an undeveloped parcel of land that is planned for future commercial in the Village of Warrenville. Given this situation, and that Warrenville is looking into the creation of a Tax Increment Financing (TIF) District to cover costs of the intersection improvements, it would be beneficial for Aurora to disconnect this portion of property so Warrenville can assume responsibility for the improvements. Duke Realty, owner of the property, is in agreement that the property should be annexed to Warrenville and is currently developing their end of the documents necessary for this to occur.

IMPACT STATEMENT:
There will be no negative impact on this proposal given that Warrenville will be responsible for intersection improvements, and Duke Realty's Butterfield Business Park (located in Aurora) will have access to Rt. 59.
