SUBJECT:
A Resolution establishing application and license fees for private immobilization of vehicles on private property.

PURPOSE:
Attached is a resolution setting the application and license fees for private immobilization of vehicles on private property pursuant to Section 46-65 of Chapter 46 of the City of Aurora's Code of Ordinances.

BACKGROUND:
On June 23, 2015, the City Council passed Ordinance O15-025 which allowed for the licensing and regulation of private vehicle immobilization services on private property. Section 46-65 of the Private Immobilization Ordinance allows the City Council to set application, license and renewal fees by ordinance or resolution.

DISCUSSION:
In accordance with Section 46-65 of the City of Aurora's Code of Ordinances, the proposed application fee of $250.00 for the processing of a private immobilization is consistent with the fee charged to liquor license applicants and is intended to cover the costs associated with said processing, including, without limitation, cost of conduction a background check as required under Section 46-64 of the Private Immobilization Ordinance. The proposed fee of $125.00 for the actual private immobilization license and subsequent annual renewals is consistent with the fee that is already assessed for a commercial relocator's license pursuant to Section 46-55 of Chapter 46 of the City's Code of Ordinances.

IMPACT STATEMENT:
The setting of the application, license and renewal fees consistent with other similar licenses in the City of Aurora will allow for the offset of costs associated processing such an application as well as the assessment of a fee is that is just and reasonable.

RECOMMENDATIONS:
