Request for authorization to correct O26-028 (enacted on April 28, 2026), the ordinance annexing the Property located at 6S361 Old Eola Road, which consists of six parcels, to the City of Aurora, pursuant to a Water Service Agreement (ChelaBella Inc - 26-0221 / NA17/1-26.073-A/WSA - JR - Ward 10)
PURPOSE:
To amend the language on the face of ordinance O26-028, enacted on April 28, 2026, to reflect the correct names of the owners of the property.
BACKGROUND:
The ordinance as enacted on April 28, 2026, incorrectly identified the owners of record of the subject property as Heddins, Mark & Tammy, who were the former owners. The correct owner is ChelaBella Inc, and the correct owner was identified accurately in the Memo that accompanied the ordinance.
DISCUSSION:
Staff attempted to record the ordinance with the DuPage County Recorder, however, the County Recorder's Office identified the error on the face of the ordinance. Staff seeks approval from the City Council to correct this error and replace the incorrect ordinance with the corrected ordinance. The original memo, ordinance and vote sheet adopting the ordinance are attached as Exhibit – Sept 22, 2026.
RECOMMENDATIONS:
Staff recommends that the City Council grant authorization to the City Clerk to amend the third Whereas paragraph of O26-028 by replacing the names “Heddins, Mark & Tammy” with “ChelaBella Inc” and further authorize the City Clerk to certify the amended ordinance O26-028 as a complete and accurate copy of the ordinance enacted by the City Council on April 28, 2026.
