Resolution Establishing the Maximum Number of City of Aurora Liquor Licenses by Class.
BACKGROUND:
This request is presented in accordance with the 2011 amendment to the City's Liquor Ordinance, specifically Section 6-9(a), which charges the City Council with the authority to determine the number of licenses available in each classification.
DISCUSSION:
U Samba Corporation d/b/a U Samba, located at 37 W New York Street, Aurora, IL has submitted a liquor license application for a Class E license for the purpose of selling to the general public alcoholic liquor by the drink for consumption on the premises where sold, and not for resale in any form, provided that such sales shall be only in conjunction with the sale of food for consumption on the premises.
Per Sec. 6-7 of the City of Aurora's Liquor Ordinance, any sale, transfer, or assignment of fifty (50) percent or more of the ownership of the business shall terminate the license. U Samba Corporation, d/b/a U Samba, 37 W New York Street, Aurora, IL has been operating out of this location for the past three Years, but there was a recent ownership change of One Hundred (100%) percent. The change in ownership automatically decreases the number of available liquor licenses by one (1), thus requiring City Council approval to increase the same by one (1) in order to accommodate the new license.
Attached is the application submitted for your consideration. If approved, this resolution would increase the number of allowable liquor licenses as indicated in the accompanying Exhibit A to allow for the issuance of the licenses by the Commissioner. City staff has been working with the business representatives to ensure that all requirements for a liquor license, as set forth in Chapter 6 of the City's Code of Ordinances, are met.
