SUBJECT:
Resolution Establishing the Maximum Number of City of Aurora Liquor Licenses by Class.

PURPOSE:
To increase the number of Class C - Package Liquor licenses by one (1) license, increasing the total maximum number of Class C to 40.

BACKGROUND:
This request is presented in accordance with the 2011 amendment to the City's Liquor Ordinance, specifically Section 6-9(a), which charges the City Council with the authority to determine the number of licenses available in each classification.

DISCUSSION:
El Palenque, Inc., located at 363 N. Farnsworth Av., has submitted a liquor license application seeking a Class C license for the purpose of selling alcoholic liquor to the general public in original packages only, for consumption off the premises where sold.

Per Sec. 6-7 of the City of Aurora's Liquor Ordinance, any sale, transfer, or assignment of fifty (50) percent or more of the ownership of a business shall terminate the license. El Palenque has been operating out of this location for over a decade, but there was a recent ownership change of fifty (50) percent. The change in ownership automatically decreases the number of available liquor licenses by one (1), thus requiring City Council approval to increase the same by one (1) in order to accommodate the new licensee. There will be no net change in the number of available class C licenses.

Attached is the application submitted for your consideration. City staff has been working with the business owner to ensure that all requirements for a liquor license, as set forth in Chapter 6 of the City's Code of Ordinances, are met.
