SUBJECT:
Resolution Concerning the Review of "Closed" Executive Session Minutes

PURPOSE:
To provide for the opening of previously closed executive session minutes

BACKGROUND:
The "closed" executive session minutes have been reviewed, and a recommendation being made that certain of those minutes shall remain closed, while others shall be opened to public inspection.

DISCUSSION:
A review has been conducted, and the attached Resolution along with the Schedules A and B contain the information regarding such minutes remaining closed, or being opened.

IMPACT STATEMENT:
No impact.

RECOMMENDATIONS:
I recommend that the Resolution be presented to the Committee of the Whole for recommendation of approval to the City Council.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

WHEREAS, the Mayor and City Council of the City of Aurora have met from time to time in closed "executive" session for purposes authorized by the Illinois Open Meetings Act, 5 ILCS 120/1 et seq.(the "Act"); and

WHEREAS, as required by the Act the City Clerk has kept written minutes of all such executive sessions; and

WHEREAS, it has been determined that a need for confidentiality still exists as to the executive session minutes from the meetings set forth on Schedule "A", attached hereto; and
