SUBJECT:
An Ordinance Amending the Lease at the Aurora Airport between the City of Aurora and Sky Haven of Aurora, Inc.

PURPOSE:
This amendment was requested by Sky Haven of Aurora, Inc. in order to restate and bring their lease current with operating conditions at the airport.

BACKGROUND:
Sky Haven has had a lease at the Aurora Airport since 1983, and the lease has been amended 7 times during the intervening years. Sky Haven is interested in restating the lease into one document incorporating all of the prior amendments, as well as providing for current operating conditions.

DISCUSSION:
Primarily, this amendment deals with issues surrounding the commercial activities allowed on the premises, as well as the direct and indirect aviation activities, as defined by the Minimum Standards and Rules and Regulations at the Airport.

IMPACT STATEMENT:
There shall be no quantifiable impact by approval of this amended lease.

RECOMMENDATIONS:
I request approval of the Ordinance amending the Lease between the City and Sky Haven of Aurora, Inc."

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
