SUBJECT:
Resolution to award a contract to HR Green, Inc. for design engineering services for the design of retention basins and the preliminary design for the potential extension of Commons Drive between Ogden Avenue and 75th Street (Ward 10 and Ward 8). The contract will be in the amount of $182,000.

PURPOSE:
This resolution and agreement is needed to comply with the Redevelopment Agreement with Aurora Town Center Associates (ATCA) in the design of retention facilities at and around the development site at the Ogden and 75th Street TIF.

BACKGROUND:
The City and ATCA executed a Redevelopment Agreement in early 2019 regarding the triangular parcel east of the intersection of Ogden Avenue and 75th Street. ATCA's proposed development consists of four phases, as indicated in Exhibit B. As a part of the four phase redevelopment of the triangle bordered by Ogden Ave, 75th Street, and the future Commons Drive the City is responsible for certain retention costs as well as the construction of a Commons drive extension. The design of a Commons Drive extension is only required after the completion of Phase 1 of the project and after design of Phase 2 has been initiated. The Commons Drive extension only needs to be completed at the same time as the completion of Phase 2 of the development. Practically speaking it may be in the City's best interest to work with the developer to complete the design of the Commons Drive extension somewhat sooner, but unfortunately the funding of the project to complete the extension relies on both Phases being completed in order for the Tax Increment to pay for the bonds for the project. This issue involves the integration of the site and the building of the road.
