SUBJECT:
Authorizing an Access Agreement between NICOR, Commonwealth Edison and the City of Aurora for 421 S. River Street

PURPOSE:
NICOR and Commonwealth Edison have requested access to use City property adjacent to their remediation project at 421 S. River Street.

BACKGROUND:
Attached is the Access Agreement which has been negotiated and agreed to by both NICOR and Com Ed for use of the City owned property north of their property for ingress and egress for their project related construction traffic.

DISCUSSION:
NICOR and Com Ed have been conducting demolition and environmental remediation of their storeroom property located at 421 S. River Street (NW corner of S. River and Prairie Streets). They expect to complete the project by the end of 2015. Their vehicles and trucks are currently using an entrance on River and an exit on Prairie, both of which are very close to the intersection of River and Prairie and requires the westbound lane of Prairie to be closed. The attached Access Agreement includes all of the City's required terms and conditions for access and use of City property and has been reviewed and approved by the Law Department and outside environmental counsel.

IMPACT STATEMENT:
Impact of approval of this Access Agreement will include reopening the westbound lane of traffic on Prairie Street and allowing for safer entry of construction trucks into and out of 421 S. River Street. It will also allow for trucks to enter the property more efficiently off of southbound River Street as opposed to currently off of Prairie and reduce traffic backups on adjacent streets.

RECOMMENDATIONS:
That the attached Access Agreement be approved by the City Council and the Mayor authorized to execute the Agreement.
