SUBJECT:
Resolution Approving a Sewer Easement Agreement between the City of Aurora and Commonwealth Edison Company for Property Located in the Butterfield Corporate Park, Aurora, Illinois title (Petitioner - City of Aurora)

PURPOSE:
The Engineering Division has been working with Commonwealth Edison Company to obtain an easement for the construction of a sanitary sewer across Com Ed property in the Butterfield Corporate Park. Duke Realty, owners of the Butterfield Corporate Park, will be responsible for the construction of the sanitary sewer. This would allow for the decommissioning of an existing lift station constructed several years ago for the Fed Ex facility that is currently located along Butterfield Road in Aurora. As is usual for utilities such as this, once the easement is approved and construction is completed, the City will be responsible for the future maintenance of the sanitary sewer. The location of the proposed sanitary sewer in included in the Sewer Easement Agreement.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
