SUBJECT:
A Resolution Approving an Intergovernmental Agreement Between the City of Aurora and the Kendall County Cooperative Police Assistance Team (KCPAT).

PURPOSE:
The purpose of this Resolution is to seek City Council approval of an Intergovernmental Agreement (IGA) that allows the Aurora Police Department to continue its participation in the Kendall County Cooperative Police Assistance Team (KCPAT).

BACKGROUND:
On January 9, 2025, the Chief of Police executed an Intergovernmental Agreement permitting members of the Aurora Police Department to participate in the Kendall County Cooperative Police Assistance Team (KCPAT). KCPAT is a multi-agency law enforcement collaboration that includes the Illinois State Police, Oswego Police Department, Yorkville Police Department, Kendall County Sheriff's Office, the Aurora Police Department, and the Kendall County State's Attorney's Office.

At the time of execution, the Chief of Police was authorized to enter into the agreement because it included a thirty (30) day termination provision. The is a no-cost agreement and is governed by the Illinois Intergovernmental Cooperation Act (5 ILCS 220/1).

DISCUSSION:
KCPAT requires participating agencies to renew the Intergovernmental Agreement on an annual basis, with execution by the Chief Law Enforcement Executive of each participating agency.

For the current renewal period, KCPAT issued an updated Intergovernmental Agreement, which is attached to this Resolution (Exhibit A). Upon review, it was determined that the termination provision had been revised from a thirty (30) day termination clause to a ninety (90) day termination clause (Section XII(A)).

Aurora Code of Ordinances, Section 2-287(d), requires that any agreement entered into under this section be cancelable upon no more than thirty (30) days' notice. Due to the revised termination provision,...
