SUBJECT:
Ordinance Authorizing the Mayor and City Clerk to Enter into an Agreement with Metra for Operation and Maintenance of the Commuter Parking Facility in the City Of Aurora at the Route 59 Commuter Train Station.

PURPOSE:
To obtain authorization to enter into an "Agreement for Operation and Maintenance of the Commuter Parking Facility in the City of Aurora" with Metra.

BACKGROUND:
The Route 59 Commuter Train Station is located at 1090 N. Route 59, which is north of Meridian Lake Drive and West of Route 59. Metra constructed and owns the west section (attachment exhibit "B") of the underlying lands on which the Aurora's commuter parking facility is located.

The City entered into an agreement with Metra on June 25, 1996 (Ordinance No. O96-71) for the long-term operation and maintenance of the parking facility. Since 1996, the City has approved three amendments in 1997, 1999, and 2001 to the Operation and Maintenance agreement. The current agreement (20 year term) with Metra is set to expire on June 25, 2016.

DISCUSSION:
Metra and City staff have both reviewed the proposed agreement, attached as exhibit "A", Agreement for Operation and Maintenance of Commuter Parking Facility in the City of Aurora. Both parties agree that the purpose of this agreement is to ensure that the parking facility at the commuter station continues to be maintained by the City of Aurora. The term of the Operation and Maintenance Agreement is for forty (40) years from said date unless otherwise terminated by either party for any reason with ninety (90) days written notice.

IMPACT STATEMENT:
No Impact, all costs for the operation and maintenance of the parking facility are funded solely by parking fees
