A Resolution Accepting the Dedication of a Non-Exclusive Public Storm Sewer Easement and a Storm Sewer Access Easement at 1079 and 1111 S. State Route 59 being east of Commons Drive and south of 75th Street (M/I Homes of Chicago, LLC - 18-0609 / NA33/2-18.078 - DED/E - JM - Ward 8)

PURPOSE:
The Engineering Department is requesting approval of a Plat of Easement for a Non-Exclusive Public Storm Sewer Easement and a Storm Sewer Access Easement located at 1079 and 1111 S State Route 59 being east of Commons Drive and south of 75th Street to serve the development by M/I Homes of Chicago, LLC north of the property. In addition, the owner of the property is providing M/I Homes with a temporary construction easement in order to construct the public sewer utilities.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

WHEREAS it may be necessary in the future to construct and provide utilities in the easement area; and

WHEREAS, upon petition of the property owners, the City of Aurora has been offered in dedication suitable vacant land for the purpose of locating utilities and/or providing stormwater detention ...
