PURPOSE:
Final Plan Revision on 0.9 acres to enclose the patio for the Sonic drive-in restaurant located at 2974 Kirk Road

BACKGROUND:
This Final Plan Revision petition, which is part of the TMK Aurora Venture, LLC Special Use Planned Development, was referred by the City Council to the Planning and Zoning Division on September 3, 2013.

DISCUSSION:
Proposal:
The proposal consists of replacing the outdoor roofed patio with an enclosed dining room in the exact same building footprint. The room is proposed to have a glass fa?ade with no significant design change to the support beams or roof. The number of seats inside the dining room is proposed to be a 38 maximum, which does not require additional parking spaces be added. The remaining existing elements of the Subject Property will remain as-is.

Evaluation:
Staff has reviewed the Final Plan Revision petition. The proposal is substantially consistent with the previously approved Final Plan and may even improve the site by enclosing restaurant business sound.

The Planning Commission recommended Approval of the Final Plan Revision petition, with no discussion.

Public Input:
As of the date of this report, staff has not received any public inquiries regarding this petition.

IMPACT STATEMENT:
The Planning and Zoning Division does not anticipate any impact to other City Departments with the approval of this petition.
