SUBJECT:
An Ordinance amending Chapter 42, Article X entitled "Construction of Facilities in the Public Rights of Way"

PURPOSE:
To update the Code provisions to include regulations specific to the placement of telecommunication, data and wireless communication facilities in the public rights of way

BACKGROUND:
Wireless communications have become very commonplace, and yet our regulations dealt only with telecommunications through "wired" facilities, therefore we desire to update these provisions to specifically include wireless communication facilities and equipment.

DISCUSSION:
The City has encountered more frequent requests for locating wireless communication equipment and facilities, particularly around known data centers, that will lead to a proliferation of towers and antennas if not appropriately regulated.

IMPACT STATEMENT :
No impact is foreseen upon city departments or the general public.

RECOMMENDATIONS:
I request approval by the Council of this Ordinance amending Chapter 19 to create a new Article VI dealing with wireless communication facilities.
