SUBJECT:
Resolution Authorizing the City of Aurora to Enter into a Residential Lease Agreement for 817 Forest Avenue.

PURPOSE:
To obtain City Council approval to enter into a new residential lease agreement through December 31, 2018 should both parties mutually agree, for city-owned property located at 817 Forest Avenue, Aurora, IL.

BACKGROUND:
The Parks & Recreation Division has leased the city-owned property at 817 Forest Avenue to various City employees for almost 40 years in order to preserve our residential asset and ensure regular oversight of adjacent Garfield Park. Denise Hakala has been the tenant since April of 2011. Historically, employee tenants have been required to perform duties typically not associated when renting residential property. These duties include: reporting of criminal activity, ordinance violations and maintenance issues at the park; opening and closing bathroom facilities; opening and closing access gate for the Garfield Park parking lot; and advising park users when the park is closed. In exchange for these services the tenants pay below market rates.

DISCUSSION:
The current and new lessee, Denise Hakala, will assume all the duties historically performed by previous tenants, plus will manage the after-hours concessions operated by seasonal city staff at Solfisburg and Garfield Parks for a reduced rent of $560.00 per month. Consistent with the previous lease agreement, after the lease term ends it becomes a month to month lease with an annual rent increase of 3%. In addition, there is a 60 day termination clause and the term is for a one year period which provides the City an opportunity to review rental rates and duties on a periodic basis.
