Ordinance Authorizing the Sale of the Westerly 45.42 feet of City Real Estate (LOT 31) (except the north 40 feet thereof) Located at 333 West ParkAvenue, Aurora, Illinois

PURPOSE:
Attached is an Ordinance Authorizing the Sale of the westerly 45.42 feet of City Real Estate (Lot 31) (except the north 40 feet thereof) commonly known as 333 West Park Avenue, with PIN# 15-22-102-032 to Daniel C. Fitzpatrick, Sr., who owns the property directly west of the area to be sold (337 West Park Avenue). Under the terms of the proposed sale, Fitzpatrick will pay the City One Dollar ($1.00) and consolidate the land with his current parcel. This sale only includes the westerly 45.42 feet (5') of the said property PIN #15-22-102-032. Per the previous Ordinance just passed, the City transferred the easterly five feet of (Lot 31) to Mr. & Mrs. Howard who own the property east of 333 West Park.

BACKGROUND:
In November 2014 the City of Aurora purchased the property at 333 West Park Avenue, Aurora, Illinois with density reduction funds. The structures on the property have been raised. The property is currently exempt from real estate taxes. The lot is to be split and given to the adjoining land owner (Fitzpatrick) as legally described below:

THE WESTERLY 45.42 FEET OF LOT 31 (EXCEPT THE NORTH 40 FEET THEREOF)IN BLOCK 2 OF J.R. AND J.C. HANNA'S ADDITION TO AURORA, IN THE CITY OF AURORA, KANE COUNTY, ILLINOIS.

DISCUSSION:
The City has made this type of arrangement before with adjacent owners in order to dispose of vacant City-owned lots.

IMPACT STATEMENT:
Property will be back on the tax rolls. City will no longer have to maintain the parcel.

RECOMMENDATIONS:
Place on Finance Committee Calendar (7/12/16 Agenda) for approval to City Council.
