PURPOSE:
To decrease/increase the number of Class K (Catering) by one (1) and Class L (Riverboat) Liquor Licenses by two (2).

BACKGROUND:
This request is presented in accordance with the 2011 amendment to the City's Liquor Ordinance, specifically Section 6-9(a) which charges the City Council with the authority to determine the number of licenses available in each classification.

DISCUSSION:
Hollywood Casino Aurora, Inc., the current licensee, is part of a larger corporation that is undergoing a merger/reorganization. As a result of the corporate restructuring, a newly formed limited liability company, HC Aurora, LLC, will be the new liquor licensee. The restructuring will not affect the physical facility currently doing business as Hollywood Casino Aurora nor will there be a change in its administration.

Attached is the application submitted for your consideration. If approved, this resolution would decrease/increase the number of allowable liquor licenses as indicated in the accompanying Exhibit A to allow for the issuance of the license by the Commissioner. City staff has been working with Casino representatives to ensure that all requirements for a liquor license, as set forth in Chapter 6 of the City's Code of Ordinances, are met.

IMPACT STATEMENT:
The proposed resolution ensures the continued operation of a long-standing and important commercial enterprise in the City of Aurora.
RECOMMENDATIONS:
I am recommending that this resolution be referred to the Government Operations Committee for consideration at its next meeting to be held on October 22, 2013. Additionally, I am requesting that said Committee refer this matter directly to City Council, as a new business item, for final action on October 22, 2013.
