SUBJECT:
Appointment of Liquor Control Hearing Officer.

PURPOSE:
To fulfill the purpose of Article II in Chapter 6 providing for the appointment of up to two Liquor Control Hearing Officers.

BACKGROUND:
The City has ongoing need for hearings to determine culpability in liquor cases, and the Council added Article II to Chapter 6 for the purpose of adding objective outside attorneys as hearing officers to assist in this endeavor.

DISCUSSION:
Eduardo J. Gil is a partner in The Gil Law Group with offices in Aurora and West Chicago. Mr. Gil established the law firm in 1994 following a career with the Kane County State's Attorney's Office as a felony prosecutor. He is active in the Aurora community and has served on numerous boards in the city. Mr. Gil has receieved recognition for his work as an attorney and in 2016 was named a "Top 100 Civil Plaintiff Trial Lawyer" by the American Trial Lawyers Association.

IMPACT STATEMENT:
This position is paid $75 for hearings lasting less than 90 minutes, and $150 for hearings lasting longer than 90 minutes.

RECOMMENDATIONS:
It is recommended that Eduardo J. Gil be appointed as a Liquor Control Hearing Officer.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
