SUBJECT:
A Resolution Authorizing the Execution of a Roadway Agreement regarding the roadway improvement to the intersection of Sullivan and Deerpath Road in Kane County, Aurora, Illinois, 60506 (The Missner Group - 18-0437 / SG12/2-18.049-DST - TV - Ward 5)

PURPOSE:
The Petitioner, The Missner Group, is requesting approval of a Roadway Agreement regarding the roadway improvement to the intersection of Sullivan and Deerpath Road. The details of the proposal outlines the construction of roadway improvements to realign Sullivan Road at the intersection of Sullivan Road and Deerpath Road and reimbursement provisions by the City to the developer for the City's share of the roadway improvements.

BACKGROUND:
The Petitioner is requesting approval of a Roadway Agreement regarding the realignment of Sullivan Road at the intersection of Sullivan Road and Deerpath Road.

Under the agreement, the Petitioner is required to fund one hundred (100%) of the Roadway Improvements with the exception that the City agrees to reimburse the developer for contributions that were previously collected for these roadway improvement from the adjacent property owners, being $56,014.75. This will be reimbursement to the Petitioner in one installment once proper invoices for expenditures are received and accepted.

Concurrently with this agreement, a Special Use Planned Development, Plat of Vacation, Final Plat Revision and Final Plan, are being reviewed and approved concurrently under separate actions.

DISCUSSION:
Staff has reviewed the Roadway Agreement petition and have sent comments back to the petitioner on those submittals. The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances.
