A Resolution Approving a Church Site Plan Review For An Existing Building On 1.40 Acres As Per Section 4.2.H. Of The Aurora Zoning Ordinance, For The Property Located At 4000 Westbrook Drive In The City Of Aurora, IL. 60504 (APPEALABLE) 

 

PURPOSE:

The petitioner, ROC Westbrook, LLC, on behalf of Abundant Life Family Church, is proposing a Church Site Plan Review for a 13,060 square foot building on 1.40 acres for a religious place of worship at 4000 Westbrook Drive.

 

BACKGROUND:

The Church Site Plan Review petition was referred by City Council to the Planning & Zoning Division on January 14, 2014

 

DISCUSSION:

PROPOSAL:  Abundant Life Family Church is requesting a Church Site Plan Review for an existing 13,060 square foot building at 4000 Westbrook Drive.  The AZO allows religious institutions in all zoning districts provided certain conditions are met.  If they are all met, then a Church Site Plan Review petition, with a public meeting at the Planning Commission, is required to review any site planning issues.

EVALUATION:  The proposed use will get an active user into this vacant and deteriorating structure.  The building will be upgraded where necessary, the parking lot will be maintained, and new landscaping will be supplemented.  Abundant Life Family Church has been ministering in the City of Aurora since 1990.  The proposed use will not result in traffic congestion, will not impact adjacent properties, and all utilities and infrastructure are already in place.  The petitioner meets all other criteria for location of a religious institution.

 

IMPACT STATEMENT:

This project will not have any negative impact on the public or other Departments of the City.

 

RECOMMENDATIONS:

The Planning Commission recommends approval of the Church Site Plan Review for 4000 Westbrook Drive.

\WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, WHEREAS, by petition dated January 7, 2014, ROC Westbrook, LLC filed with the City of Aurora a Site Plan for , as described on Exhibit "B" attached hereto; for the property legally described on Exhibit “A”; and

 

WHEREAS, the petitioner has properly notified all owners of property within 250 feet of said property of the public meeting of the Aurora Planning Commission at which this case was to be heard, as provided by Ordinance; and

 

WHEREAS, on February 5, 2014 said plan was duly presented by the Zoning Administrator and Director of Planning to the Aurora Planning Commission which, in a public meeting, determined that the plan meets all of the Ordinances and Planning Standards of the City of Aurora, and referred said plan to the Planning & Development Committee of the Aurora City Council for its review; and

 

WHEREAS, on February 13, 2014, the Planning & Development Committee of the City Council of the City of Aurora, Illinois, hereby concurs with the Planning Commission, and determines that said Site Plan for  is in conformance with the Ordinances and Planning Standards of the City of Aurora; and

 

WHEREAS, the recommendation of the Planning & Development Committee is subject to appeal by the petitioner or a member of the Aurora City Council within the required appeal period which expires on  at 5:00 p.m.; and

 

WHEREAS, this resolution shall serve as final action on the request in the event that this resolution is not appealed by any of the aforementioned individuals; and

 

WHEREAS, in the event that this resolution is appealed, it shall serve as the recommendation of the Planning & Development Committee to the City Council which shall take final action on the request; and

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of Aurora, Illinois, as follows: finds as facts all of the preamble recitals of this Resolution, accepts the recommendation of the Aurora Planning Commission, and hereby approves said Site Plan for the church, and hereby directs the Aurora Zoning Administrator to issue a building permit to said church.
