An Amended Ordinance Providing for the Execution of an Amended Easement Agreement between the City of Aurora and Commonwealth Edison for the Aurora Transportation Center (ATC) Regional Facility Enhancement Project. (ComEd - 17-00914 / AU22/2-17.012-AG/C - SP - Ward 2)
PURPOSE:
This dedication of easement to Commonwealth Edison to facilitate the undergrounding of utilities proposed in the Customer Work Agreement entered into with Commonwealth Edison by the City with Resolution R2017-116 on April 11, 2017.
BACKGROUND:
The City Council voted on October 24, 2017 to approve the an Ordinance Providing for the Execution of an Easement Agreement between the City of Aurora and Commonwealth Edison for the Aurora Transportation Center (ATC) Regional Facility Enhancement Project with Ordinance O17-079.

DISCUSSION:
The inclusion of Comcast Cable Communications LLC as a grantee of the easement was inadvertently left off the original document approved by City Council. As Comcast has existing overhead utilities on the utility poles the City desires to be removed the inclusion of Comcast Cable Communications LLC is necessary.
IMPACT STATEMENT :
Therefore the Staff recommends that the City Council approve the attached amended Easement Agreement.
RECOMMENDATIONS:
Staff would recommend APPROVAL of the Ordinance Providing for the Amended Execution of an Easement Agreement between the City of Aurora and Commonwealth Edison for the Aurora Transportation Center (ATC) Regional Facility Enhancement Project.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City desires to dedicate an Amended Easement to Commonwealth Edison providing for the relocation of underground utilities for the ATC Regional Facility Enhancement Project across a portion of the property located at 238 N Broadway and 360 N Broadway in the form of Exhibit “A” attached hereto.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, that the City Council of the City of Aurora hereby authorizes and directs the Mayor and the City Clerk to execute the Amended Easement as attached hereto as Exhibit “A” and made part hereof.
