A Resolution Approving a Revision to the Preliminary Plan and Plat for the Property Located at West Side of Deerpath Road and the North Side of I-88 for a Warehouse, Distribution, and Storage Services (3300) use to elect to utilize the ORI(S) zoning classification as provided in the approved Plan Description. (Panattoni Development Company, Inc. - 18-0554 / SG01/4-17.268-Ppn/Psd/R - SB - Ward 5)
PURPOSE:
The Petitioner, Panattoni Development Company, Inc., is requesting approval of a revision to the Preliminary Plat and Plan for Orchard Industrial Subdivision, Lot 1, which is located on the west side of Deerpath Road and the north side of I-88, for a Warehouse, Distribution, and Storage Services (3300) use, and to elect to utilize the ORI(S) zoning classification as provided in the approved Plan Description.
BACKGROUND:
The Subject Property is currently Vacant Land/Open Space with B-B(S) Business-Boulevard District with a Special Use Planned Development zoning. The subject property is located in Parcel C, as identified in the existing Plan Description, which was approved as O1999-040 and allows for the developer to elect to utilize either the B-B(S) or ORI(S) zoning district for development. The approved Preliminary Plat and Plan, which was approved as R1999-209, utilized the B-B(S) zoning district. Additional information on the legislative history of the property can be found in the attached Property Research Sheet.
The Petitioner is requesting approval of a revision to the Preliminary Plat and Plan. The details of the request include a one lot subdivision of the subject property, which will be utilized for an approximately 764,500 square foot spec building for warehouse and office use. This Preliminary Plat and Plan Revision also elects to change the subject property's zoning district from the current B-B(S) to ORI(S) as allowed per the approved Plan Description.
In addition, the Preliminary Plat and Plan also details the subject property's stormwater management and utilities. Roadway improvements are also detailed to be made along Deerpath Road from the northern property to no less than one hundred feet of the southern access point, and right-of-way will also be dedicated along both sides of Deerpath Road.
DISCUSSION:
Staff has reviewed the Preliminary Plan and Plat Revision petition and have sent comments back to the Petitioner on those submittals. The Petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances, with the exception of the items reflected in the conditions listed in the Staff Recommendation below.
POLICIES AND GUIDELINES:
The Staff's Evaluation and Recommendation are based on the following Physical Development Policies:
41.1 (1): To attract and encourage industrial, office and office-research development to
planned sites where requisite public facilities are either present or proposed.
41.1 (3): To encourage the location of industrial, office, and office-research development
near transportation facilities designed to provide adequate and efficient linkages
to sources of labor, production, production materials, and markets.
41.1 (5): to promote attractive, well-maintained industrial and office-research areas
through landscaping and site design.
RECOMMENDATIONS:
The Planning Commission recommend CONDITIONAL APPROVAL of the resolution approving a revision to the Preliminary Plat and Plan for the property located at the west side of Deerpath Road and the north side of I-88, with the following conditions:
1) Full-width and full-depth roadway improvements, including street lighting, are to be completed for Deerpath Road, from the north end of the property to no less than one hundred (100) feet south of the curb on the south side of the southerly entrance to the site.
2) Right-of-way for Deerpath Road along the subject property's frontage, on both sides of Deerpath Road, and in front of the commercial property located at 2114 Deerpath Road, shall be dedicated, and all issues with the Illinois State Toll Highway Authority regarding property and/or easements that may be in conflict with the right-of-way dedication and construction of Deerpath Road shall be resolved prior to occupancy.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, by petition dated June 27, 2018, Panattoni Development Company, Inc., filed with the City of Aurora a petition Requesting approval of a Revision to the Preliminary Plan and Plat for Orchard Industrial Subdivision located on the west side of Deerpath Road and the north side of I-88 for Warehouse, Distribution and Storage Services (3300) Use to elect the ORI(S) zoning classification as provided in the Plan Description and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-2”; and
WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on August 8, 2018, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, on August 16, 2018, the Planning and Development Committee of the Aurora City Council reviewed said Preliminary Plan and Plat Revision and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Preliminary Plan and Plat with the following conditions:
