SUBJECT:

An Ordinance Granting a Shed Area, Size, and Height variance pursuant to Section 10.5 and Section 4.4-6.6 for property located at 106 LeGrande Boulevard being the south east corner of LeGrande Boulevard and Garfield Avenue (Alexandra Juriga - 16-00783 / AU20/2-16.143-V - ES - Ward 4)  

 

PURPOSE:

The Petitioner is requesting approval of a Shed Area, Size, and Height Variance pursuant to Section 4.4-6.6 and Section 10.5 for the property at 106 LeGrande to allow for a 20' x 16' shed being 320 square feet in area, 20’9” in height, with a 20’ wall length, and a 9'-11" vertical wall height.  

 

BACKGROUND:

The Subject Property is located at 106 LeGrande Boulevard, located at the southeast corner of LeGrande Boulevard and Garfield Ave and is currently utilized as a single family residence with R-1 One Family Dwelling zoning.  The property is 0.53 acres in size, and is in an area of large residential lots. 

 

DISCUSSION:

The Petitioner's home currently has a 2 car attached garage which will barely hold 2 vehicles.  The home is 4,700 sf. in size and there are six residents in the family.  Adding onto the attached garage was explored but is not practical.  Therefore, the Petitioner is proposing an oversized shed to accommodate room for family bikes, sporting equipment, riding lawn mower, garbage/recycling cans, snow blowers, ladders and other various lawn and garden tools and equipment.  The small existing 8 x 10 shed on the south lot line will be removed.  The shed is designed to match the architecture of the existing home style (English Tudor) with stones and half-timber construction.  As new owners, the Petitioners have made many improvements to the home and property.  The location of the shed at the end of the driveway along with new landscaping will blend it into the property.  The scale of the shed to the property size should not negatively impact surrounding properties, and in fact should enhance them. 

 

POLICY AND GUIDELINES:

22(1) To promote the social and economic stability of residential neighborhoods so as to enhance their living environment.

22(5) To recognize the unique characteristics of individual neighborhoods and promote their positive attributes.  

 

RECOMMENDATIONS:

The Zoning Board of Appeals recommended CONDITIONAL APPROVAL of said Variance, with the following condition:

 

1)  No stairs are to be installed to the attic storage level of the shed.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, Stephen & Alexandra Juriga are the owners of record of the real estate legally described on Exhibit “A-1”, attached hereto and incorporated herein by reference as if fully set forth, and hereafter referred to as Exhibit “A-1”; and

 

WHEREAS, by petition dated August 11, 2016, filed with the City of Aurora requesting approval of a Shed Area, Size, and Height Variance pursuant to Section 4.4-6.6 and Section 10.5 for the property at 106 Le Grande Boulevard to allow for a 20' x 16' shed being 320 square feet in area, 20’9” in height, with a 20’ wall length, and a 9'-11" vertical wall height per Exhibits "A-2" Building Elevations; and

 

WHEREAS, after referral of said petition from the Aurora City Council, and after due notice and publication of said notice, the Zoning Board of Appeals conducted a public hearing on September 21, 2016, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and

 

WHEREAS, on September 29, 2016, the Planning and Development Committee of the Aurora City Council reviewed said petition and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and

 

WHEREAS, the City Council, based upon the recommendation and the stated standards of the Planning Commission, finds that the proposed Variance is not contrary to the purpose and intent of Ordinance Number 3100, being the Aurora Zoning Ordinance; and

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows:

 

Section One: That the City Council of the City of Aurora, Illinois finds as fact all of the preamble recitals of this Ordinance.

 

Section Two: That this Ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.

 

Section Three: That all Ordinances or part of Ordinances in conflict herewith are hereby repealed insofar as any conflict exists.

 

Section Four: That any section, phrase or paragraph of this Ordinance that is construed to be invalid, void or unconstitutional shall not affect the remaining sections, phrases or paragraphs of this Ordinance which shall remain in full force and effect.

 

Section Five: That the real property commonly known as and legally described on Exhibit “A-1” is hereby granted CONDITIONAL APPROVAL of said Variance, with the following condition:

 

1)  No stairs are to be installed to the upper storage level of the shed.
