SUBJECT:

A Resolution Accepting the Dedication of a City Easement at 423 Sperry Court  (City of Aurora - L15-00647 / AU27/1-15.130-DED/E - TMc - Ward 4)  

 

PURPOSE:

The Petitioner, City of Aurora, is requesting approval of a Plat of Easement on Lot 7 of County Clerks Subdivision at 423 Sperry Court.  

 

BACKGROUND:

The easement is for combined sewer separation into sanitary and storm sewer. The existing 8-inch clay pipe combined sewer currently runs through the proposed easement. The City will install a 12-inch storm sewer to provide additional drainage relief and meet the objective of the City’s Long Term Control Plan to reduce combined sewer overflows. The current resident is having basement seepage problems whenever it rains. This project accomplishes two objectives; basement flooding relief, and EPA-mandated reduction of drainage to the combined sewer to reduce combined sewer overflows to the Fox River.. 

 

DISCUSSION:

Staff has reviewed the Easement petition and it meets the applicable codes and ordinances.  

 

POLICIES AND GUIDELINES:

The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:

10.0 To provide for the orderly, balanced and efficient growth and redevelopment of the City through the positive integration of land use patterns, functions, and circulation systems. To protect and enhance those assets and values that establishes the desirable quality and general livability of the City. To promote the City’s position as a regional center.

91.1 (5) To protect drainage ways and potential reservoir site to provide for management of storm water runoff, over bank flooding, and ground water recharge.

91.1 (3) To encourage the maintenance and enforcement of Federal and State environmental quality standards.  

 

RECOMMENDATIONS:

Staff would recommend APPROVAL of the A Resolution Accepting the Dedication of a City Easement at 423 Sperry Court.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREASit may be necessary in the future to construct and provide utilities in the easement area; and

 

WHEREAS, upon petition of the property owners, City of Aurora, the City of Aurora has been offered in dedication suitable vacant land for the purpose of locating utilities and/or providing stormwater detention within an easement(s) as described on Exhibit “A” Plat of Easement attached hereto; and

 

WHEREAS, the City desires to receive and accept the granting of such real estate, in accordance with Section 11-105-01 of the Illinois Municipal Code (65 ILCS (1994) 5/11-105-1); and 

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, as follows: that upon petition of the property owners, the City hereby receives and accepts the granting of the easement(s) as described on Exhibit “A” Plat of Easement attached hereto; provided however, that such acceptance of granting does not relieve the developer of its obligations to construct such utilities in accordance with the City of Aurora Public Improvement Ordinance.
