SUBJECT:

A Resolution Authorizing an Intergovernmental Agreement between the City of Aurora and East Aurora School District No. 131 regarding School Developmental Impact Fees (East Aurora School District No. 131 - 17-00213 / KDWK-17.029-AG/IGA - TV)  

 

PURPOSE:

Attached is a resolution authorizing the execution of an intergovernmental agreement with the East Aurora School District No. 131 to establish school developmental impact fees.  

 

BACKGROUND:

The City Council adopted an Ordinance on December 12, 2000, by Ordinance Number O00-181, which provided for contributions in the form of impact fees to be paid to or on behalf of any school district located in whole or part in Aurora from certain owners, located within such school district in order to help address demands  on  such  school  districts  to  provide  classrooms,  teachers,  and  educational materials. 

 

DISCUSSION:

A school impact fee, by definition, is a fee that is imposed by a local government for the benefit of a local school district to help offset the cost of providing services as a result of new development. The City recognizes that growth, particularly residential growth, does and will have an immediate impact on the school districts located within the City of Aurora. School districts have demonstrated that such applicable new development in the City create a real and demonstrated need for new and or expanded school buildings, teachers and educational materials.  For Aurora, impact fees are based upon a combination of the number of bedrooms and construction value of each residential dwelling unit.  Impact fees are a one-time fee paid at the time of issuance of the transfer tax for each new unit.  The impact fee schedule proposed by East Aurora School District No. 131 is Exhibit "A" in Ordinance No. O2000-181. 

 

POLICIES AND GUIDELINES / IMPACT STATEMENT:

The adoption of this resolution will have no impact on the City of Aurora, other than the collection and disbursement of the school impact fee by the Finance Department, which is currently being done for other school districts.  

 

RECOMMENDATIONS:

Staff would recommend APPROVAL of the Resolution Authorizing an Intergovernmental Agreement between the City of Aurora and East Aurora School District No. 131 regarding School Developmental Impact Fees.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora (hereinafter “City”) and East Aurora School District No. 131 (hereinafter “SD131”) are each legal entities organized and existing under the laws of the State of Illinois, having among their powers the authority to contract with one another to perform the undertaking described herein; and

 

WHEREAS, the purpose of the Intergovernmental Cooperation Act and Article 7, Section 10 of the 1970 Constitution of the State of Illinois include fostering cooperation among units of local government in planning and providing services to their constituents; and

 

WHEREAS, the City and SD131 are public agencies within the meaning of the Illinois Intergovernmental Cooperation Act as provided for in 5 ILCS 220/1, et seq.; and

 

WHEREAS, the City Council of the City of Aurora has determined that it is in the best interest of the City and its residents to enter into this Agreement; and

 

WHEREAS, the City Council has reviewed and approved the attached Intergovernmental Agreement. 

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, as follows: that the attached Intergovernmental Agreement,  attached hereto and made a part hereof as Exhibit "A" between the City and SD131 for School Developmental Impact Fees be approved, and the Mayor of the City of Aurora is hereby authorized and directed to execute the Intergovernmental Agreement on the behalf of the City.

 

NOW THEREFORE, BE IT FURTHER RESOLVED that City Clerk be directed to transmit certified copes of this Resolution and the attached Intergovernmental Agreement to East Aurora School District No. 131 with copies to the City of Aurora Corporation Council and the Finance Director.
