A Resolution Consenting to the Assignment of Aviation Operating Agreement at the Aurora Municipal Airport between the City of Aurora and ARR-OW 2, Inc. to Glass Simulation Center & Logistics, Inc., a Wisconsin Corporation.
PURPOSE:
To obtain City Council approval of an Assignment of Aviation Operating Agreement between the City of Aurora and ARR-OW 2, Inc. to Glass Simulation Center & Logistics, Inc.
BACKGROUND:
ARR-OW 2, Inc. has operated on the Aurora Municipal Airport since June 9, 2009. The company operates flight simulator training and services. ARR-OW 2, Inc. desires to sell the company to Glass Simulation Center & Logistics, Inc. Glass Simulation Center & Logistics, Inc. will operate the same business offering simulator training and services.
DISCUSSION:
ARR-OW 2, Inc. has provided an asset to the airport. The owner of ARR-OW 2, Inc. wishes to retire and sell the business. The airport desires to have Glass Simulation Center & Logistics continue the operation of this business. The Aurora Municipal Airport Advisory Board has recommended this assignment of agreement.
IMPACT STATEMENT:
Approval will offer a positive impact on the City and the Airport; this will offer the continuation of an existing business and its services.
RECOMMENDATIONS:
I concur with the Aurora Airport Advisory Board's recommendation to approve this Assignment of Aviation Operating Agreement.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City of Aurora entered into a Direct Aviation Operating Agreement at the Aurora Municipal Airport dated June 9, 2009 under Resolution R09-234, with ARR-OW 2, Inc.; and
WHEREAS, ARR-OW 2, Inc. desires to assign the Direct Aviation Operating Agreement to Glass Simulation Center & Logistics, Inc., a Wisconsin Corporation; and
WHEREAS, said assignment would benefit the operation of the airport and would therefore be a benefit to the City of Aurora; and
WHEREAS, the Aurora Municipal Airport Advisory Board has recommended the assignment of an agreement between the City of Aurora and ARR-OW 2, Inc. be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows:
Section One: That the Mayor and City Clerk are hereby authorized to execute the Assignment of Aviation Operating Agreement between the City of Aurora and ARR-OW 2, Inc. attached hereto and made a part hereof as EXHIBIT "A".
Section Two: That this Resolution shall take effect from and after its adoption and approval as required by law.
