SUBJECT:

A resolution authorizing payment to JULIE Incorporated in amount of $28,906.49 for services to be received in 2016.

 

PURPOSE:

The 2016 annual Assessment Invoice is based on a total of 23,848 requests to locate the City's publicly owned utilities for the previous assessment period. This invoice reflects the total cost for the City's JULIE services that will be received for 2016.

 

BACKGROUND:

The Illinois Underground Utilities Facilities Damage Prevention act (220ILCS50) requires that individuals or organizations request a location of underground utilities prior to excavating 6 inches or more below ground surface. As a result of the aforementioned law, the Joint Utilities Locating for Excavators (JULIE) was formed. The purpose for JULIE is to act as a clearing house to convey locate requests to the various utility owners who may own facilities in the area of the proposed excavation. The City is a governmental member of JULIE.

 

DISCUSSION:

The 2016 Water and Sewer Division Budget provides funding for this expense in account number 510-4063-511.44-07 (Water and Sewer Fund).

 

IMPACT STATEMENT:

The owners of underground utilities are mandated by the aforementioned Act to locate their below grade improvements if requested as part of any excavation. Complying with the Act potentially saves lives and minimizes damage to public infrastructure.

 

RECOMMENDATIONS:

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the 2016 Annual Assessment Invoice is based on 23,848 utility locate requests received through JULIE Incorporated for the previous assessment period; and

 

WHEREAS, the Illinois Underground Utilities Facilities Damage Prevention Act (220ILCS50) requires the City to locate its underground utilities if requested as part of excavation work; and

 

WHEREAS, the 2016 budget provides for funding for this work in account number 510-4063-511.44-07 Water and Sewer Fund.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Director of Purchasing is hereby authorized to make payment to JULIE Incorporated in the amount of Twenty Eight Thousand Nine Hundred and Six Dollars and 49 Cents ($28,906.49) for the distribution of utility locate request to the City of Aurora for 2016.
