A Resolution Authorizing Execution of a Roadway Construction and Finance Agreement for roadway improvements for the intersection of N. Orchard Road and Sullivan Road, and Sullivan Road and Sequoia Drive in Kane County (QuikTrip Corporation - 26-0658 / AU07/1-26.172 - Agr/Rd - JM - Ward 5)
PURPOSE:
The Petitioner, QuikTrip Corporation, is requesting approval of a Roadway Agreement for the intersection of N. Orchard Road and Sullivan Road, and Sullivan Road and Sequoia Drive for roadway improvements associated with the development of Lots 1-8 of the Fourth Resubdivision of Toyota Subdivision, located at the northeast corner of Sullivan Road and Orchard Road.
BACKGROUND:
In 2025, the owner of the property requested to rezone the property at the northeast corner of Sullivan Road and Orchard Road from ORI Office, Research, and Light Industrial District to R-4(C) Two-Family Dwelling District with a Conditional Use, B-2(C) General Retail District with a Conditional Use, and OS-1(C) Conservation, Open Space, and Drainage District with a Conditional Use zoning. A requirement of the Conditional Use Planned Development was for the Developer to enter into a Roadway Agreement with the City regarding improvements to the surrounding intersections. The Roadway Agreement outlines that the Developer agrees to construct an extension to increase the storage to the westbound left-turn lane at N. Orchard Road and Sullivan Road, being approximately 500 feet in its entirety, and modify the existing median on Sullivan Road at Sequoia Drive to accommodate a future traffic signal and truck turning movements. The construction of said Roadway Improvements shall be fully completed prior to issuance of the certification of occupancy for Quiktrip.
In addition, the City desires a traffic signal at Sullivan Road and Sequoia Drive to accommodate existing and future traffic flows. To further this future goal, the Developer agrees to pay a cash contribution of $375,000 (half of the Estimated Costs) to the City for said future traffic signal.
DISCUSSION:
Staff has reviewed the Roadway Agreement petition and have sent comments back to the petitioner on those submittals. The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances.
IMPACT STATEMENT:
This agreement will allow for the construction of roadway improvements to the intersection of N. Orchard Road and Sullivan Road, and Sullivan Road and Sequoia Drive with no cost to the City and will provide funding for future improvements.
RECOMMENDATIONS:
Staff recommends APPROVAL of A Resolution Authorizing Execution of a Roadway Construction and Finance Agreement for roadway improvements for the intersection of N. Orchard Road and Sullivan Road, and Sullivan Road and Sequoia Drive in Kane County.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, on June 2, 2026, QuikTrip Corporation filed with the City of Aurora a request for the requesting approval of a Roadway Agreement for the intersection of N. Orchard Road and Sullivan Road, and Sullivan Road and Sequoia Drive. and related required documents as attached hereto as Exhibits "A"; and
WHEREAS, for reasons set forth in the Agreement the City and QuikTrip Corporation wish to enter into said attached Agreement regarding requesting approval of a Roadway Agreement for the intersection of N. Orchard Road and Sullivan Road, and Sullivan Road and Sequoia Drive; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, as follows: that the Mayor and City Clerk be and are hereby authorized to execute the attached Agreement.
NOW THEREFORE, BE IT FURTHER RESOLVED that City Clerk be directed to file and keep on record said Agreement and a certified copy of this Resolution.
