SUBJECT:

A Resolution approving intergovernmental agreements between the City of Aurora and other local agencies to use the Bureau of Alcohol, Tobacco and Firearms (ATF) equipment for the National Integrated Ballistic Information Network (NIBIN).

 

PURPOSE:

The City of Aurora, through the Aurora Police Department, entered into an agreement with the ATF to use their equipment and NIBIN network to enhance the parties ability to combat, link and solve violent crimes involving firearms. .

 

BACKGROUND:

As a partner to the ATF, the Aurora Police Department houses NIBIN equipment and access to the NIBIN network.  As part of the agreement, Aurora can enter into additional agreements with local agencies to use the ATF equipment.

 

DISCUSSION:

This agreement with allow the Aurora Police Department to work with local agencies to use the ATF's NIBIN equipment and network to help solve crimes involving firearms.  The agreement defines for each agency how to handle the evidence, the requirements to utilize the equipment, coordinating scheduling, etc. ATF has provided equipment, which is housed at the Aurora Police Department.  The Aurora Police Department is requesting City Council to approve the Aurora Police Chief the authority to sign agreements under this agreement with the ATF, with the surrounding police agencies that apply to use the equipment. 

 

IMPACT STATEMENT:

Allowing Aurora Police Department to enter into these agreements with local agencies is beneficial to Aurora and surrounding communities in quickly link and solve crimes involving firearms.

 

RECOMMENDATIONS:

The Aurora Police Department requests the approval of this Resolution and the approval for the Aurora Police Chief, to sign the agreements as local agencies apply to use the NIBIN system.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the Aurora Police Department and the Bureau of Alcohol, Tobacco, and Firearms (ATF) have entered into an agreement for the Aurora Police Department to house National Integrated Ballistic Information Network (NIBIN) equipment and network access at the Aurora Police Department.

 

WHEREAS, that as part of the agreement, Aurora grants other agencies the ability to access the NIBIN network through an Intergovernmental Agreement with other local agencies.

 

WHEREAS, the NIBIN network assists police agencies in efforts to combat, link and solve violent crimes involving firearms and is beneficial for the use by the Aurora Police Department and other local agencies.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows:

 

Section One: That the Police Chief of the City of Aurora is authorized to execute agreements with local agencies as part of the agreement with ATF on the use of NIBIN equipment and network that is housed at the Aurora Police Department.

 

Section Two: That the City Clerk shall be the record keeper of the signed intergovernmental agreements between the Aurora Police Department and local agencies who are authorized to use the NIBIN network and equipment.
