SUBJECT:
Resolution authorizing the purchase of new duty ammunition for sworn police personnel.
 
PURPOSE:
To obtain the Finance Committee's and the City Council's approval of a proposed resolution that would authorize the purchase of new duty ammunition for a total cost of $25,056.14.
 
BACKGROUND:
Like many goods, ammunition is somewhat perishable.  Over time, it can become less effective and reliable.  As a result, the ammunition that is carried by sworn police personnel on duty must be replaced from time to time.  In addition to needing to have ammunition that has not degraded over time, we want to have ammunition that is the most effective in the first place, as there is a big variety of manufacturers, intended uses, and manufacturer claims.    
 
DISCUSSION:
A recent study conducted by the Aurora Police Department showed that the most effective duty/law enforcement ammunition is manufactured by two companies - Federal and CCI/Speer.  (Federal out-performed CCI/Speer in some calibers, while CCI/Speer out-performed Federal in others.)  Kiesler's Police Supply, located in Indiana, is the sole law enforcement distributor for both Federal and CCI/Speer law enforcement ammunition for the states of Illinois, Indiana, Ohio, Michigan, and Kentucky.
 
Because it is necessary to replace officers' duty ammunition on a regular basis, this purchase is required due to it not having been done in the last several years.  
 
We are requesting an exception to the competitive bidding requirements, as allowed in section
2-335(a)(3) of the Aurora Municipal Code.  A signed affidavit with these details has been submitted.
 
A decision package for $35,500 was approved for the purchase of duty ammunition for 2014.  These funds are available in account 101-3536-421.61-17.

RECOMMENDATIONS:
The recommendation is that the City Council adopt the attached resolution that would authorize the purchase of new duty ammunition, as proposed, for $25,056.14.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, the Police Department desires to purchase new duty ammunition; and
 
WHEREAS, the total cost for this ammunition is $25,056.14 and the 2014 Budget provides for this in account 101-3536-421.61-17; and
 
WHEREAS, pursuant to Aurora Code Section 2-335(a)(3) the desired ammunition is available from Kiesler's Police Supply as the sole law enforcement distributor for Federal and CCI/Speer Law Enforcement ammunition for the states of Illinois, Indiana, Michigan, Ohio, and Kentucky.
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: the City Council does hereby accept the bid for Kiesler's Police Supply, to purchase new duty ammunition for $25,056.14 and does hereby further authorize its Purchasing Director to issue the necessary orders to implement purchase of same.
