SUBJECT:

Resolution Authorizing the Execution of an Intergovernmental Agreement between the City of Aurora and the Fox Valley Park District Concerning the Fireworks and Other Programmed Activities on Park District Property on July 4, 2017, 2018 and 2019. 

 

PURPOSE:

Execution of an Intergovernmental Agreement with the Fox Valley Park District for 4th of July activities 2017 through 2019.

 

BACKGROUND:

The City of Aurora has been hosting the 4th of July activities on Fox Valley Park District property since the opening of RiverEdge Park in 2013. We are looking to continue that relationship with a three-year Intergovernmental Agreement.

 

DISCUSSION:

McCullough Park will provide the venue for entertainment, vendors, amenities and fireworks viewing.  Veterans Island will be utilized for the launch site.  The attached Intergovernmental Agreement formalizes what has been past practices and shows a renewed spirit of cooperation with the Fox Valley Park District.  

The City will take care of all logistics and programming and has meet with the FVPD to assure all needs are covered. 

 

The FVPD Board, staff and Legal Counsel have reviewed and approved the attached IGA as well as the City's Corporation Counsel. 

 

IMPACT STATEMENT:

The IGA will allow the City and Park District to work together to make the largest event of the year a success for our residents. 

 

The City services impact for this event will be covered in the Governmental Operations Request put forth for the fireworks and evening activities.

 

RECOMMENDATIONS:

I request the attached resolution be reviewed by the Finance Committee and sent on to City Council for final approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the city of Aurora and Fox Valley Park District are each legal entities organized and existing under the laws of the State of Illinois, having among their powers the authority to contract with one another to perform the undertaking described herein; and 

 

WHEREAS, the City of Aurora and the Fox Valley Park District have agreed to the terms set forth in the attached Intergovernmental Agreement, which provides for the use of Fox Valley park District property for the staging of the City of Aurora 4th of July activities 2017 through 2019;

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: Authorize and execute the attached Intergovernmental Agreement on behalf of the City.
