Resolution Authorizing the Mayor to Execute the Construction Contract in the amount of $2,217,100.43 with Plote Construction Inc. for the Duke Parkway Extension Project
PURPOSE:
This Resolution will approve the Contract to Construct Duke Parkway at Illinois Route 59.
BACKGROUND:
The Illinois Department of Transportation (IDOT) recently awarded the City of Aurora a funding opportunity through the Department's Economic Development Program (EDP). The EDP will provide 50 percent of the funds to construct the extension of Duke Parkway and a new intersection at Illinois Route 59. These funds will provide safe adequate access to the Amazon Company, which plans to create 1,200 new positions.
DISCUSSION:
Duke Realty LP and their Engineering Consultant completed design plans and specifications for the roadway improvements. Plans were approved by IDOT. The EDP funding agreement required the City of Aurora to be the Awarding Authority. The Project was advertised locally for public bids and proposals were opened on June 21, 2017.
The bid tabulation for the 5 bids received is attached as Exhibit A. The lowest responsible bid was submitted by Plote Construction Inc. of Hoffman Estates, IL in the amount of $2,217,100.43 which is nearly 45% less than the Engineer's Cost Estimate. Plote is prequalified with IDOT and capable of completing this project. We recommend awarding the Duke Parkway Extension Project to Plote Inc. for the unit prices submitted.
The entire cost of this project will be paid for with funds from the awarded EDP funds and remaining balance funded by Duke Reality Limited Partnership. Payments for construction and engineering will be processed through the escrow account established by Duke and the City of Aurora with American Title Insurance Company, Escrow Number NCS853018.
Construction is expected to begin as soon as possible and the contract deadline is November 17, 2017.
IMPACT STATEMENT:
Traffic along Illinois Route 59 may be impacted during some stages of construction.
RECOMMENDATIONS:
Please forward this resolution to the Finance Committee for their review and recommendation for approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City of Aurora was awarded up to $2,000,000 from the Illinois Department of Transportation's (IDOT) Economic Development Program (EDP) to provide 50 percent of the costs to construct the extension of Duke Parkway and a new intersection at Illinois Route 59; and
WHEREAS, it is necessary and desirable to construct these improvements to provide access to the Amazon Company to create 1,200 new positions; and
WHEREAS, bids were received and publicly opened and read on June 21, 2017 with bid tabulation attached hereto and incorporated as Exhibit 'A'; and
WHEREAS, Plote Construction Inc., 1100 Brandt Drive, Hoffman Estates, IL 60192 was the lowest responsible bidder in the amount of Two Million Two Hundred Seventeen Thousand One Hundred and Forty Three Cents ($2,217,100.43); and
WHEREAS, the funds for this project will be provided in an escrow account established by Duke Reality LP and the City of Aurora with American Title Insurance Company, Escrow Number NCS853018 copy of account is attached hereto and incorporated herein as Exhibit 'B'; and
WHEREAS, balance of projects costs including construction and engineering that exceed the EDP grant will be paid for by funds from Duke Reality LP to be deposited into said Escrow Account; and
WHEREAS, in the event IDOT does not provide the EDP funds in a timely manner, Duke Reality LP will deposit the anticipated authorized EDP funds into the Escrow Account.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor is hereby authorized to execute a contract with Plote Construction Inc. for the unit prices shown within the bid as set forth in Exhibit 'A'
BE IT FURTHER RESOLVED that the Mayor is hereby authorized any other such documents related to advancement and completion of said project.
