Requesting approval for the City to enter into a lease agreement with SprintCom, Inc. to install and maintain communications equipment on the monopole located at 1325 W. Indian Trail Road.
PURPOSE:
To execute a Lease Agreement with SprintCom, Inc., to install and maintain communications equipment on the monopole located at 1325 W. Indian Trail Road.
BACKGROUND:
SprintCom, Inc. has made a request to place communications equipment on the monopole located at 1325 W. Indian Trail Road. The attached Lease is a standardized for Lease that was developed a number of years ago which the City has consistently used in these types of matters.
DISCUSSION:
The lease is for five years with (3) five year renewal options. Rent starts at $3,000.00 a month with 4% increase annually. The Lease provides for the security concerns of the Water Production Department, given the close proximity of the monopole to the City's water tower, and provides indemnification for the City of Aurora for any liability associated with the installation and operation of the facility and for repair and replacement of any damage to the City monopole.
IMPACT STATEMENT:
The lease provides for the installation of communication equipment which will benefit the connectivity of Sprint customers residing in Aurora. The monthly rent will also provide added source of revenue.
RECOMMENDATIONS:
It is recommended that this item be placed on the agenda for the June 9, 2015 Finance Committee meeting for review and consideration with ultimate referral to City Council for final approval.

An Ordinance Authorizing the Execution of a Lease Agreement with SprintCom, Inc. for the Placement and Operation of Communication Facilities on the Monopole located at 1325 W. Indian Trail Road, Aurora, Ilinois.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City of Aurora owns a monopole located 1325 W. Indian Trail Road, Aurora, Illinois; and
WHEREAS, the City desires to enter into a Lease Agreement with SprintCom, Inc. for an initial period of five (5) years, with three five year options to renew thereafter, for the placement and operation of communication services equipment and facilities at the West Indian Trail Road Monopole site; and
WHEREAS, in accordance with 65 ILCS/11-76-1 and, in furtherance of its home rule powers, it is desirable for the City of Aurora to enter into said Lease Agreement with SprintCom, Inc.; and
WHEREAS, pursuant to Ordinance O98-09 and Chapter 19, Section 19-69 of the City of Aurora Code of Ordinances, the location of said communications facilities on property owned or otherwise controlled by the City of Aurora is a Permitted Use.)
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows:
Section One: That the Mayor is hereby authorized to execute the attached Lease Agreement with SprintCom, Inc.
Section Two: That this ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.
Section Three: That any Section or provision of this ordinance that is construed to be invalid or void shall not affect the remaining Sections or provisions which shall remain in full force and effect thereafter.
